Finnish Court Cuts Simon Ekpa’s Jail Term To Four Years

A Finnish Court of Appeal has reduced Biafran separatist Simon Ekpa’s prison sentence from six years to four, upholding his convictions for terrorism offences linked to his campaign for an independent Biafran state.

The ruling, delivered on October 15, 2026, upheld a September 2025 judgment by the Päijät-Häme District Court, which found Ekpa guilty of publicly inciting crimes for terrorist purposes and participating in a terrorist group.

The prosecution had sought a harsher sentence, while Ekpa argued that the violence in southeastern Nigeria constituted an armed conflict that should be assessed under international humanitarian law rather than Finland’s domestic terrorism legislation.

The appeals court examined the organisation, weaponry and military capacity of the groups involved, alongside the intensity of the fighting.

It found evidence of an internal armed conflict but ruled that sporadic clashes, insufficient evidence of sustained military operations and the absence of significant civilian displacement did not establish the intensity required for a civil war.

The court nevertheless reduced Ekpa’s sentence after considering the circumstances surrounding the offences, without overturning his terrorism convictions.

The case concerned activities between 2021 and 2024 aimed at advancing Biafran independence. The separatist movement dates back to Nigeria’s 1967–1970 civil war, which ended with Biafra’s defeat and reintegration into Nigeria.

Ekpa, 41, moved to Finland from Nigeria as an athlete in 2007 and later served on a public transport committee in the Lahti region as a representative of the National Coalition Party. He has been in custody since November 2024.

The District Court also convicted him of aggravated tax fraud and an offence under legislation governing the Finnish Bar Association.

The ruling is not final. Ekpa may seek leave to appeal to Finland’s Supreme Court.
